Judge Orders No Bond for Deming Vehicle Theft Suspect With Prior Felony Case

DEMING – A Deming man accused of stealing a vehicle earlier this month will remain behind bars without the option of bond. According to KTSM-TV, the Sixth Judicial District Attorney’s Office says 28-year-old Nicholas Day was ordered held after a judge found he poses a danger to the community.

Prosecutors allege Day unlawfully took a motor vehicle and was already on probation at the time of the incident. During the hearing, the State requested that two additional charges be added — aggravated assault with a deadly weapon and conspiracy to commit perjury — a request the court approved.

Court officials also noted that Day has an open felony case in Doña Ana County involving vehicle theft, which factored into the judge’s decision to deny bond as the case moves forward.

Day is presumed innocent unless and until proven guilty in a court of law.
